Mobile App Policy

e-clinic (“we”, “us”, “our” and “ours”) mobile app policy is a provider of patient management systems and services in the medical sector, we are registered in England and Wales under company number 06912469 and our registered office is at 10-12 Eastcheap, First Floor, London, England, EC3M 1AJ

Introduction

1. privacy policy and (ii) this Mobile App policy, apply to your use of:

1.1. BookmyClinic mobile application software (App) [available on our website] OR hosted on [https://login.bookmyclinic.co.uk]] (App Site), once you have downloaded, streamed or otherwise installed a copy of the App onto your mobile telephone or handheld device (Device)

1.2. Any of the services accessible through the App (Services) that are available on the App Site or other websites of ours (Services Sites) unless your end user licence states that a separate privacy policy applies to a particular Service, in which case that separate privacy policy.

2. Our privacy policy and this Mobile App policy set out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please note that the App is not intended for children, and we do not knowingly collect data relating to children.
 
As the Device upon which the App is installed is in your possession and under your use and control, you agree that you are responsible at all times for ensuring that no child is permitted or given the opportunity to use this App. 
 
Please read our privacy policy and this Mobile App policy carefully to understand our practices regarding your personal data and how we will treat it.
 
3. We keep our Mobile App policy under regular review. This version was last updated on 11th October 2021.  It may change and if it does, these changes will be posted on our website or the App Site and/or, where appropriate, notified to you by email when you next start the App or log onto one of the Services websites. The new policy may be displayed on-screen, and you may be required to read and accept the changes to continue your use of the App or the Services.

Consent to installation of the App

4. Before installation of this App, please indicate your consent to our processing of your personal data (including your name, contact details, financial and device information) as described in our privacy policy and this Mobile App policy:

YES, I consent to the installation of the App for the purposes of booking appointments.

NO, I do not consent to the installation of the App.

5. Once you provide consent by selecting "YES", you may change your mind and withdraw consent at any time by contacting us in accordance with our privacy policy but that will not affect the lawfulness of any processing carried out before you withdraw your consent.

Consent to processing Location Data

6. Please indicate whether you consent to us processing Location Data:
YES, I consent to processing of my Location Data ([including details of my current location disclosed by GPS technology so that location-enabled Services are activated [to locate nearby clinics).

NO, I do not consent to processing of my Location Data and location-enabled Services are disabled in my settings.

Data we collect about you

7. In addition to the types of personal data identified in our privacy policy, we may, though your use of the Mobile App, collect, use, store and transfer additional kinds of personal data about you as follows:

7.7. Marketing and Communications Data.

8. We also collect, use and share aggregated data such as statistical or demographic data for any purpose. Aggregated data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific App feature. However, if we combine or connect aggregated data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data (in which case it will be processed only in accordance with our privacy policy and this Mobile App policy).

9. Your personal data may be collected whenever you download or register an App, subscribe to any of our Services, search for an App or Service, share data via an App's social media functions, enter a competition, promotion or survey and when you report a problem with an App, our Services, or any of our websites.

10. We also use GPS technology to determine your current location. Some of our location-enabled Services require your personal data for the feature to work. If you wish to use the particular feature, you will be asked to consent to your data being used for this purpose. You can withdraw your consent at any time by disabling Location Data in your settings.

11. We may also receive information about you from other sources including third parties and publicly available sources, including those set out below:

11.1. Device Data from the following parties:

11.1.1. analytics providers [such as Google].
11.1.2. advertising networks [such as Google]; and
11.1.3. search information providers [such as Google].

11.2. Contact, Financial and Transaction Data from providers of technical, payment and delivery services [such as ClearAccept.

11.3. Identity and Contact Data from data brokers or aggregators [such as Google].

Cookies and other tracking technologies

13. When you use our Mobile App, we use cookies and/or other tracking technologies to distinguish you from other users of the App, App Site, the distribution platform (Apple App Store, Google Play Store) or Services websites and to remember your preferences, amongst other things. Purposes for which we will use your personal data:

14. In addition to the purposes for which we normally use personal data (as set out in our privacy policy) we will use your personal data, as follows:

14.1. To install the App and register you as a new App user

14.2. To process in-App purchases and deliver Services including managing payments and collecting money owed to us

14.3. For marketing and communications

14.4. Where we have a legitimate interest to do so, including:

    • to recover debts due to us
    • to analyse how you are using our products/ Services
    • to enable you to participate in a prize draw, competition or complete a survey
    • to deliver content and advertisements to you
    • to monitor trends so we can improve the App, to develop our products/Services and grow our business.

Description of categories of Personal Data referred to in this Mobile App policy:

18. The following terms have the following meanings:

18.1. Financial Data: bank account and payment card details.

18.2. Transaction Data: includes [details about payments to and from you and details of in-App purchases.

18.3. Device Data: includes the type of mobile device you use, a unique device identifier for example, your Device's IMEI number, the MAC address of the Device's wireless network interface, or the mobile phone number used by the Device. Mobile network information, your mobile operating system, the type of mobile browser you use, time zone setting.

18.4. Content Data: includes information stored on your Device, including friends' lists, 12 login information, photos, videos or other digital content, check-ins.

18.5. Profile Data: includes your username and password, in-App purchase history, your interests, preferences, feedback and survey responses.

18.6. Usage Data: includes details of your use of any of our Apps or your visits to any of our website [or other websites] including, but not limited to, traffic data and other communication data whether this is required for our own billing purposes or otherwise and the resources that you access.

18.7. Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preference.
